NORMAN MUSIC FESTIVAL TERMS AND CONDITIONS 

By entering this application to The Norman Music Alliance, Inc., d/b/a Norman Music Festival, an Oklahoma Not for Profit Corporation (the “NMF”) for the 2026 Norman Music Festival (the “Festival”), I (referred to as “I”, “You”, “Your”, “Me”, “My”, “Applicant” or “Artist”) acknowledge and agree to the following Terms and Conditions:

• I have read and agree to the NMF Code of Conduct and agree to adhere to the terms therein.

• I have reviewed the terms of this application and agree to the eligibility criteria and entry deadline, which are incorporated into these Terms and Conditions, and agree to those application terms.

• I understand that my submission of this application does not guarantee my selection to participate in the Festival. NMF’s selection criteria are set forth in the application and these Terms and Conditions, and its decisions are made in NMF’s sole discretion. NMF is under no obligation to provide feedback to applicants. NMF reserves the right at any time after receipt of your application to accept or decline you for any reason.

• If I am chosen by NMF to perform at the Festival, I agree to provide my services at the Festival in the form of a performance that is substantially similar to the submission being submitted herein, which shall take place on April 23, 24, or 25 of 2026, as selected by NMF at its sole discretion (the “Performance”). In the event I cannot provide the Performance promised herein, I agree to notify NMF no later than 30 days prior to the Festival by emailing talent@normanmusicfestival.com. I understand that if I do not perform at the Festival or the Festival is Cancelled, I forego any payment I may have received for my Performance.

• As the Artist, I am solely responsible for protecting any intellectual property rights (including without limitation patents, trademarks, copyrights, trade secrets, etc.) in my application, participation, product, service and/or idea, and have had opportunity to consult with legal counsel before participating in the Festival. I understand that sharing proprietary information on the internet carries inherent risks, including piracy, and I assume those risks and indemnify NMF from any copyright infringement claims related to my submission or Performance at the Festival. I further represent that I am familiar with the copyright laws of the Unites States and shall not include in my Performance or submit with my application any material that would breach said copyright laws. In the event I breach this representation, I agree to Indemnify and Hold Harmless NMF and its employees, agents, attendees, and participants against all liability, loss, damages, claims and expenses (including attorney’s fees) arising out of or related to such breach.

• By submitting this application, I hereby grant NMF a perpetual, irrevocable, worldwide, royalty-free license in any copyright, trademark, right of personality or publicity or other propriety rights in and to the following exclusively for use in connection with the 2026 Festival or future Festivals hosted by NMF, its affiliated services, media, or press to: (i) photograph, film, and record my Performance at the Festival (“Recordings”); (ii) use my name, image, likeness, headshot, bio and voice, all as provided by me, in connection with the advertisement and promotion of the Festival (“My Likeness”); and (iii) display, distribute, reproduce, publicly perform, edit, translate, advertise, promote and exhibit the Recordings by any method or device now known or hereafter devised. I understand and agree that there will be no financial or other monetary compensation to me for such use of My Likeness in the Recordings and no material incorporating My Likeness need be submitted to me for any further approval and NMF shall be without liability to me for any use of My Likeness. NMF agrees to contact the Artist for any publication of Recordings or My Likeness beyond use for promotion of the Festival as stated herein and agrees to not re-publish or sell Recordings or My Likeness without the Artists express written permission.

• I understand and acknowledge that by performing at the Festival, I am providing services as an independent contractor and not as an employee of NMF. I retain sole creative control of my Performance and understand that my participation in the Festival does not confer any rights to me as an employee, partner or agent of NMF.

• NMF is the owner of all right, title and interest in and to the trademarks NORMAN MUSTIC FESTIVAL and NMF, along with other trademarks and corresponding logos, social media and promotional images or other materials embodying the same provided by NMF to Applicant (collectively, the “NMF Marks”). NMF hereby grants Applicant a non-transferable, non-sublicensable, limited, non-exclusive, royalty-free, revocable license (“License”) to use, reproduce, and display the NMF Marks until April 25, 2026 (the “Term”) to promote the Artist’s participation, solely as they are embodied and contained with the NMF provided social media images and promotional materials. Any additional use of the NMF Marks, requires NMF’s prior written approval. All use of the NMF Marks by Applicant and all goodwill will inure to the exclusive benefit of NMF. All rights not licensed herein are explicitly reserved by NMF. NMF reserves the right to revoke this License at its sole discretion. In the event Artist uses the NMF Mark for any purpose other than for the promotion of Artists performance at the Festival, Artist shall be liable for any claims affiliated with such non-licensed use.

• If I am selected to perform at the Festival, I shall have the option to sell merchandise during my Performance and shall retain all proceeds related to such sales. I agree to keep a proper sales ledger and provide an accounting to the Festival if requested. Likewise, Artist shall have no right to compensation for any merchandise sold by the Festival or any other participating Artist.

• The Terms and Conditions stated herein shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to the principles of conflict of laws. By submitting this application, and in the event a dispute arises, Artist consents to the exclusive jurisdiction of the courts located in the State of Oklahoma in the venue of Cleveland County for any legal action, suit or proceeding arising out of or in connection with these Terms and Conditions. Artist further waives any objection to the laying of venue for any such suit, action or proceeding in such courts. Any fees, including reasonable attorney’s fees, incurred in relation to a dispute of this agreement shall be bore by the losing party.

• Any rights or obligations conferred to the Artist herein shall not be assigned without the prior written consent of NMF.

Applicant acknowledges and agrees that Applicant has read and understands the Terms and Conditions and intends to be legally bound by its terms. Applicant acknowledges that the information contained in the application is accurate, that they have the rights necessary to share the materials contained herein and that the application will not violate any third-party rights or laws of any kind. By clicking the box below or by using any other electronic mechanism presented to signify acceptance of these Terms and Conditions, Applicant agrees to and accepts these Terms and Conditions.

The Norman Music Alliance, Inc. d/b/a Norman Music Festival (hereinafter “NMF”) is a non-for-profit corporation which exists to help people pursue their creative goals and share their art with the community. This goal is achieved in part by annually hosting a free music festival in downtown Norman, Oklahoma (the “Festival”). In order to maintain the ability to continuously host this event, all participants must adhere to certain baselevel protocols put in place to protect the businesses who, each year, must consent to the festival’s ongoing existence, as well as for the protection of the thousands of individuals who attend this event.

 
NORMAN MUSIC FESTIVAL CODE OF CONDUCT 

By attending this event, you are subject to these terms and NMF reserves the right at any time to enforce this Code of Conduct at its discretion:

1. The Festival is not a place for inappropriate behavior that is disruptive, abusive, or illegal.

2. NMF defines inappropriate behavior as conduct or action that violates NMF policies or protocols (including those pertaining to health and safety) or that undermines the spirit of the Festival, including any form of written, verbal or physical abuse or threats, illegal or disruptive activities, the use of derogatory or discriminatory language, gestures or actions, any form of harassment, racism, sexism, or any other targeted comments which may violate any local, state or federal laws or cause harm to another Festival participant, whether before, during or after NMF events. This Code of Conduct applies to conduct both online and in person, through social media channels, through use of NMF mobile apps, or while engaging in any online aspect of the Festival, or any other method of communication.

3. NMF may take action in its discretion to address any individual(s) or group(s) it believes fail to meet the standards set forth in this Coe of Conduct, including without limitation, revoking the violating party’s participation in the Festival or other NMF event.

4. During the Festival, NMF expects all attendees of the event follow public health guidelines related to safety, hygiene and communicable illnesses (including COVID-19) established at that time by local, state, or federal government.

5. Please contact talent@normanmusicfestival.com if you believe you have observed or experienced a violation of this Coe of Conduct, and NMF will work to assess the situation and respond as soon as possible. Notifying NMF does not constitute or replace a notification to local law enforcement. All suspected violations of the law should be reported to local law enforcement. For emergencies, immediately dial 9-1-1. For non-emergencies, the Norman Police Department is available at (405) 321-1444.
